Haibu — Terms of Service

This document covers everything you're agreeing to when you create a Haibu account: our general Terms of Service, our Privacy Policy, our Refund Policy, our Community Guidelines, and — in advance, whether or not you ever use it — our Creator Agreement. By creating an account, you agree to all five parts below in full.

Part 1 — Terms of Service
1.1 Acceptance of these Terms
By creating an account, booking a session, or offering sessions as a creator on Haibu ("the Service," "we," "us"), you agree to all parts of this document. If you don't agree, don't use the Service.
Haibu is currently operated by Raghavendra Yellapragada, a sole proprietor based in Toronto, Ontario, Canada.
1.2 Eligibility
You must be at least 18 years old to create an account, book a session, become a creator, or make or receive any payment through Haibu. This applies without exception — there is no parental-consent pathway for minors on this platform, because Haibu involves live 1-on-1 video interaction between people who may not know each other, combined with real financial transactions.
By using Haibu, you confirm that you are at least 18 and have the legal capacity to enter into this agreement.
1.3 What Haibu is
Haibu is a platform that lets guests book and pay for scheduled, live, 1-on-1 video sessions with creators. Haibu facilitates the booking, payment, and video call infrastructure. Haibu is not a party to the actual session — the session itself is an interaction between the guest and the creator.
1.4 Accounts
You're responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate information when creating your account and keep it up to date.
1.5 Booking and payment
- All bookings are paid in advance through our payment processor, Stripe.
- Prices are set by individual creators for their offerings.
- Haibu retains a platform fee from each completed transaction; the remainder is paid to the creator, subject to the payout terms in Part 5 — Creator Agreement.
- Haibu does not store your full card details — payment information is handled directly by Stripe.
1.6 Cancellations, no-shows, and refunds
Full details are in Part 3 — Refund Policy. In summary:
- Guests who cancel more than 24 hours before a session receive a full refund.
- Guests who cancel between 24 hours and 2 hours before a session receive a 50% refund.
- Guests who cancel less than 2 hours before a session do not receive a refund.
- If a creator cancels a session for any reason, the guest always receives a full refund.
- If a creator doesn't join a session, or leaves significantly early, the guest is automatically refunded a fair amount based on how much of the session was actually delivered.
1.7 Conduct during sessions
- All sessions on Haibu must remain suitable for a general audience ("SFW"). See Part 4 — Community Guidelines.
- You may not record, screen-capture, or otherwise save any part of a session without the express, explicit consent of the other participant. Haibu does not provide a recording feature and does not review or moderate live sessions in real time — you are responsible for your own conduct.
- Either participant may leave a session at any time.
- You can report a concern about another user through the in-app report feature.
1.8 Prohibited conduct
You may not use Haibu to:
- Impersonate another person or misrepresent your identity or affiliation
- Harass, threaten, or abuse another user
- Post, share, or attempt to share content that is illegal, sexually explicit, or otherwise not suitable for a general audience
- Attempt to circumvent Haibu's payment system to transact with another user outside the platform
- Use the platform for any unlawful purpose
Violating these terms may result in a warning, session cancellation, account suspension, or permanent removal from the platform, at Haibu's discretion.
1.9 Creators
If you offer sessions as a creator, you are also bound by Part 5 — Creator Agreement.
Important — read this even if you're not a creator yet: by accepting this document now, you are also accepting Part 5 in full, in advance. If you later choose to become a creator by creating a creator profile, Part 5 automatically applies to you at that point — you will not be asked to separately accept it again. Your one acceptance here, at signup, covers both. If you never become a creator, Part 5 simply never applies to you, and nothing further is required either way.
1.10 Third-party services
Haibu relies on third-party services to operate, including Stripe (payments), Daily.co (video calls), and Resend (email delivery). Your use of Haibu is also subject to the applicable terms of these providers where relevant, particularly Stripe's terms governing payment processing and payouts.
1.11 Disclaimers
Haibu provides the platform connecting guests and creators, but Haibu is not responsible for the conduct of any user during a session. Interactions between guests and creators are between those individuals. To the fullest extent permitted by law, Haibu disclaims liability for any harm, loss, or dispute arising from a session itself, beyond the refund remedies described in Part 3.
Haibu is provided "as is" without warranties of any kind, express or implied.
1.12 Limitation of liability
To the fullest extent permitted by applicable law, Haibu's total liability to you for any claim arising from your use of the Service will not exceed the amount you paid to Haibu in the 12 months preceding the claim.
1.13 Termination
You may stop using Haibu at any time. Haibu may suspend or terminate your account for violating these Terms, at our discretion, with or without notice depending on the severity of the violation.
1.14 Changes to these Terms
We may update this document from time to time. If we make material changes, we'll make reasonable efforts to notify users before the changes take effect. Continuing to use Haibu after changes take effect means you accept the updated Terms.
1.15 Governing law
This document is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Part 2 — Privacy Policy
This Privacy Policy explains how Haibu collects, uses, and protects your personal information when you use our platform, whether as a guest or a creator. Haibu is subject to Canada's federal privacy law (PIPEDA).
2.1 What we collect
Account information: your email address, display name, and (for creators) a public bio, category, and offering details.
Payment information: when you make or receive a payment, our payment processor, Stripe, collects and stores your payment details directly. Haibu does not see or store your full card number.
Booking information: session times, the offering booked, and timestamps recording when a session started and ended (used for our cancellation and refund policy).
Identity verification (creators only): creators must complete identity verification through Stripe Identity before they can receive payouts. This verification is handled directly by Stripe; Haibu stores only a confirmation that verification was completed, not the underlying documents.
Communications: if you contact our support, we keep a record of that conversation to help resolve your issue.
What we do not collect: Haibu does not record video or audio from sessions. We do not have a recording feature, and we do not store any content from your live calls.
2.2 How we use your information
We use your information to operate your account, process bookings and payments, send transactional emails (confirmations, reminders, verification codes), enforce our Terms, investigate reports of misconduct, and improve the Service. We do not sell your personal information, and we do not use your data for advertising.
2.3 Cookies
Haibu currently uses only cookies that are strictly necessary for the Service to function — for example, keeping you logged in and enabling secure payment processing through Stripe. We do not currently use advertising or cross-site tracking cookies, and no consent banner is required for the essential cookies we use. If this changes in the future, we will update this policy and, where legally required, ask for your consent before those cookies are set.
2.4 Who we share information with
We share information only as needed to operate the Service:
- Stripe — processes payments, payouts, and identity verification
- Daily.co — powers the live video call infrastructure
- Resend — delivers transactional emails
- Supabase — hosts our database and authentication system
These providers only receive the information necessary to perform their specific function and are contractually bound to handle it securely. We may also disclose information if required by law, or to protect the safety of our users.
2.5 Data retention
We retain your account and booking information for as long as your account is active, and for a reasonable period afterward to comply with legal, tax, and dispute-resolution obligations.
2.6 Your rights
Under PIPEDA, you have the right to access, correct, or request deletion of your personal information, subject to our legal and financial record-keeping obligations. Contact support@haibu.live to exercise these rights.
2.7 Data security
We use industry-standard security practices to protect your information, including encrypted connections and access controls.
2.8 Children's privacy
Haibu is not intended for anyone under 18. We do not knowingly collect personal information from anyone under 18. If we become aware that we have, we will delete it.
2.9 International data transfers
Some of our service providers may process data outside of Canada. Where this happens, we rely on our providers' own compliance with applicable data protection standards.
2.10 Changes to this policy
We may update this Privacy Policy from time to time. Material changes will be communicated to users before they take effect.
Part 3 — Refund Policy
If you need to cancel a session

Refunds are issued automatically to your original payment method through Stripe. Depending on your bank, refunds can take a few business days to appear on your statement.
If a creator cancels your session
You always receive a full refund, no matter when the creator cancels. There is no exception to this.
If a creator doesn't show up, or leaves early
Every session on Haibu is protected. If a creator misses your session entirely, or leaves significantly before the scheduled end time, you're automatically refunded a fair amount for the time you didn't receive — you don't need to request it.
- If a creator never joins your session, you receive a full refund.
- If a creator joins late or leaves early, your refund is calculated based on how much of your booked time was actually delivered.
If you don't show up to your session
If you don't join your session, no refund applies — the creator has set aside that time for you and is compensated for it.
How session timing works
Your session runs for the exact length you booked, starting at the scheduled time — it does not extend to make up for either party joining late. We recommend joining a couple of minutes early.
If something goes wrong that isn't covered above
Contact us at support@haibu.live within 72 hours of your session. We review these requests individually.
Part 4 — Community Guidelines
Haibu is a place for genuine, friendly, one-on-one connection — casual conversation, ASMR, music, and similar categories. Everyone on Haibu should feel comfortable, respected, and safe.
Keep it SFW
Every session on Haibu must remain suitable for a general audience. This applies to both guests and creators, in every category. Sexually explicit conduct, nudity, or content of that nature is never allowed on Haibu, in any session type.
No recording
Recording, screen-capturing, or otherwise saving any part of a session is not allowed without the clear, explicit consent of the other person. Haibu does not provide a built-in recording feature.
Be who you say you are
Don't impersonate someone else, misrepresent your identity, or pretend to be a different creator or guest.
No harassment
Harassment, threats, hate speech, or abusive behavior toward another user is not tolerated.
Stay on the platform
Bookings, payments, and communication related to a session should stay on Haibu. Don't ask another user to move a paid interaction off-platform to avoid Haibu's payment system or protections.
If something feels wrong
You can report a concern about a specific session or user directly from your booking, or block a user entirely, using the tools built into the app. If you feel unsafe during a live session, you can leave at any time — you don't need permission.
Reports are reviewed by our team. Depending on what happened, outcomes can include a warning, cancellation of future bookings between the two parties, temporary suspension, or permanent removal from Haibu.
Category-specific notes
- ASMR and casual talk sessions should stay warm and personal, but everything above still applies.
- Music sessions should be a genuine lesson, performance, or musical interaction as described in the offering.
Part 5 — Creator Agreement
When this applies to you: you already agreed to this Part, in full, when you accepted this document at signup — every account holder pre-agrees to it, whether or not they ever become a creator. It automatically takes effect the moment you create a creator profile and begin offering sessions. No separate acceptance is required at that time. This section exists so you can read exactly what applies to you as a creator, not to collect a new agreement.
5.1 Your relationship with Haibu
You are an independent creator, not an employee, agent, or partner of Haibu. You control your own schedule, pricing (within Haibu's offering system), and how you conduct your sessions, subject to Part 4 — Community Guidelines. Nothing in this Part creates an employment relationship.
5.2 Getting paid
- To receive payouts, you must connect a Stripe account through Stripe Connect and complete Stripe's identity verification process. This is Stripe's own requirement, and by connecting your account you separately agree to Stripe's Connected Account Agreement.
- Haibu retains a platform fee from each session price; the remainder is your payout.
- Payouts are held for a review period before release — 7 days for new creators, 96 hours once you've completed at least 5 sessions.
- You are solely responsible for determining and paying any taxes owed on your Haibu earnings. Haibu does not withhold taxes on your behalf.
5.3 Your obligations as a creator
- Honor your bookings. Once a session is confirmed, you're expected to show up and deliver it.
- Keep sessions SFW, per Part 4, in every category you offer.
- Represent yourself accurately in your profile, bio, and offerings.
- Set availability you can actually keep. Don't accept bookings you don't intend to honor.
5.4 Cancellations and no-shows
If you cancel a confirmed session, the guest receives a full refund, and you do not receive payment for that session, regardless of your reason for cancelling.
If you don't join a session, or leave significantly early, the guest is automatically refunded a fair amount based on how much of the session was actually delivered, per Part 3.
5.5 Reliability
If you accumulate 3 or more cancellations or no-shows within a rolling 30-day period, your account is flagged for review by Haibu. This may result in a warning, a temporary pause on new bookings, or removal from the platform, depending on the circumstances.
5.6 Content and likeness
You retain ownership of your own likeness, voice, and any content you create or share as part of your Haibu profile and sessions. By creating a profile, you grant Haibu a license to display your profile information, bio, and offerings on the platform for the purpose of operating the Service.
5.7 Suspension and termination
Haibu may suspend or remove your creator account for violating this Agreement, this document generally, or Part 4. Any payout already earned for genuinely completed sessions prior to suspension will still be paid out, subject to the standard hold period.
You may stop offering sessions and deactivate your creator profile at any time.
5.8 Changes to this Part
We may update this Part from time to time. Material changes will be communicated before they take effect.
